A request for patent is submitted to the Patent Office, where there are several different departments to deal with the different types of requests filed.
The Patent Office has four departments:
Patents Department – Deals with requests for patents.
Designs Department – Deals with requests for designs
Trademarks Department – Deals with requests for trademarks
PCT Department – Deals with international requests for patents in accordance with the PCT Treaty.
Anyone seeking patent must first submit the required documents, which will be examined by a patent examiner, who will decide if the person making the request is entitled to receive patent. In practical terms, the patent examiner is the person who at this stage, decides if the patent meets the pertinent criteria.
